JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-03-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 341, 323, 304B, 201/34 of the Indian Penal Code.

Heard learned counsel for the petitioners.

It has been submitted on behalf of the petitioners that no specific allegation is there against the petitioners, who are brother and sister-in-law of the husband of the deceased and other co-accused persons, who are mother-in-law and father-in-law, having similar allegation, have already been granted anticipatory bail vide order dated 13.12.2016 passed in Cr. Misc. no. 46809 of 2016.

Heard learned A.P.P. also.

Having heard both sides, in view of the fact that

No.8805 of 2017 (2) dt.02-03-2017 2/2 similarly situated other co-accused persons have been granted anticipatory bail, let above named petitioners, in the event of arrest or surrender within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty-five thousand only) each with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Bagaha, West Champaran, in connection with Nadi P.S. Case no. 6 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and also subject to the conditions that

(1) bailors should be local having sufficient immovable property within the jurisdiction of the court concerned, (2) petitioners shall cooperate in the investigation and make themselves available before the police as and when required.
