JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 22-10-2016 Heard learned counsel for the petitioner and learned A.P.P. representing the State.

The petitioner seeks bail in connection with Darbhanga Sadar P.S. Case No. 287 of 2016 registered for the offences punishable under Sections 420, 409, 467, 408, 471, 379, 120(B) of the Indian Penal Code.

Allegedly, the petitioner was on leave and in his place Abhishek Kumar sent Bhavnath Vats to work with Chandan Kumar in uploading the cash in ATM and after verification it was found that Rs. 10,61,500/- cash was less.

Submission is of false implication and that the petitioner was on leave from 09.07.2016 to 20.07.2016, at the

On 16.7.2106 when the petitioner got information about the said occurrence he came on 20.07.2016 at Darbhanga as on 18.7.2016 his reception was fixed. He got suspicion on Sundar Jha, Shivam and Bhavnath Vats and on his disclosure Shivam was arrested who discloses that the stolen money is in the room of Shivam and Sundar and from both room Rs. four lakhs six thousand were recovered. Prior to this occurrence Bhavnath Vats Sundar and Mukund together had stolen Rs. 4,00,000/- from PNB ATM which was known to him. The only fault of the petitioner is that he in his absence gave the password of ATM to Bhavnath and Sundar. The petitioner has committed no offence and as such he deserves sympathetic consideration.

Learned A.P.P. opposes the prayer of bail.

In the facts and circumstances stated above, considering that at the time of occurrence the petitioner was on leave and as such he is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned C.J.M., Darbhanga in connection with Darbhanga Sadar P.S. Case No. 287 of 2016, subject to the conditions that one of the bailors must be
