The petitioners seek bail in connection with Mufassil P.S. Case No. 346 of 2016 registered for the offences punishable under Section 47(a) of the Bihar Excise (Amendment) Act.
Prosecution case is that 35 liters Mahua wine was recovered from the house of the petitioners.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. The petitioners have falsely been implicated in the present case and they are languishing in custody since 25.08.2016. Nothing has been recovered from the conscious possession of the petitioners.
Patna High Court Cr.Misc. No.49835 of 2016 (2) dt.13-12-2016 2/2 On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
In the facts and circumstances stated above, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Mufassil P.S. Case No. 346 of 2016.
