The petitioner seeks bail in connection with Koransarai P.S. Case No. 02 of 2019 instituted for the offence under Section(s) 30(A) of Bihar Prohibition & Excise Act, 2018. Learned counsel for petitioner has submitted that there is no recovery of any illicit liquor from possession of this petitioner.

It is alleged in the written report that 406.08 litres of foreign liquor has been recovered from a pick up van. It is further alleged that 371.520 litres of foreign liquor has been recovered from Khaliyan of Munnilal Rai and 518.400 litres of foreign liquor has been recovered from Khaliyan of Janardan Rai.

Patna High Court CR. MISC. No.22033 of 2019(2) dt.08-04-2019 2/2 Learned counsel for petitioner submits that petitioner is not named in the seizure list. He has been made accused by the informant merely on suspicion. Nothing has been recovered from conscious possession of petitioner.

Petitioner is in custody since 15.02.2019 having clean antecedent.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-II cum Special Judge (Excise Act), Buxar in connection with Koransarai P.S. Case No. 02 of 2019, subject to the condition that both the bailors shall be the close relative of the petitioner.
