1. Heard learned counsel for the petitioners, learned A.P.P. for the State and the learned counsel appearing on behalf of the informant.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 316(2), 318, 338, 336(3) and 340(2) of BNS.
3. Learned counsel for the petitioners after some argument realizing his difficulty seeks permission to withdraw the anticipatory bail application with respect to petitioner no.1, namely, Kameshwar Singh @ Lathi Singh.
4. Permission is accorded.
5. The learned counsel for the petitioner next submits
Patna High Court CR. MISC. No.23503 of 2025(2) dt.30-04-2025 2/3 that petitioner has antecedent of one case and is a woman and the informant alleges that Kameshwar Singh committed forgery in the sale deed no. 1042 dated 04.03.2022 pertaining to Kanica mauza and sold the same to the informant, portraying as if he had purchased 2 decimal of land of Khata No.85, Plot No.682 at Sonwarsa mauza in the name of his wife (petitioner) from Shardanand Singh, further taking the informant into confidence based on the sale deed, took Rs. 5 lacs and got the said land registered by his wife in the name of the informant vide sale deed no. 3918 dated 26.07.2024 and also became a witness on the sale deed, further the informant requested him to provide a copy of the sale deed dated 04.03.2022, on which, Kameshwar Singh provided a photo copy, as such, the informant obtained the certified copy of the sale deed dated 04.03.2022 when she came to know that Shardanand Singh had sold 3 decimal of land of Kanica mauza to Soni and Gudiya.
6. The learned counsel for the petitioner submits that petitioner is wife of Kameshwar Singh and she was completely unaware about the misdeed committed, as such, merely on saying of her husband, she executed the sale deed without being aware that forgery has been committed.
7. Learned A.P.P. and the learned counsel appearing
Patna High Court CR. MISC. No.23503 of 2025(2) dt.30-04-2025 3/3 on behalf of the informant opposes the prayer for anticipatory bail of the petitioners.
8. Considering the submissions made by the learned counsel for the petitioners and also taking into consideration the fact that petitioner is a woman, the petitioner above-named, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned trial court where the case is pending/successor court in connection with Arwal P.S. Case No.323/2024, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
