JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-12-2018 The petitioner seeks bail in connection with Jehanabad P.S.Case No. 41 of 2018 registered under Sections 147,148,149,307 and 323 of the Indian penal Code and Section 27 of the Arms Act.
Allegation, as per the FIR, is that the police, during patrolling duty, seeing 6-7 persons assaulting two boys, reached at the place of occurrence. It is alleged that this petitioner and one Ujjawal Paswan having pistols in their hands, made fire from that pistols, on a public place.
Submission of learned counsel for the petitioner is that there is no allegation of any firearm injury having been received by any person moreover, petitioner is in custody since 10.07.2018 and other similarly situated co-accused Ujjawal Paswan has been granted bail by a co-ordinate Bench of this
Patna High Court Cr.Misc. No.68583 of 2018(2) dt.03-12-2018 2/2 Court vide order dated 18.08.2018 in Cr. Misc. No. 42075 of 2018.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Jehanabad in connection with Jehanabad P.S. Case No. 41 of 2018 with condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
