JUSTICE SUDHIR SINGH ORAL ORDER 26-10-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered under Sections 399, 402 of the Indian Penal Code and Sections 25(1-b)a, 26/35 of Arms Act.

The allegation against the petitioner is that one country made pistol and four live cartridges were recovered from his possession It has been submitted on behalf of the petitioner that the petitioner is in custody since 15.04.2016. Charge sheet has been submitted in this case. There is no allegation of tampering with the witnesses alleged against the petitioner. One country made pistol and four live cartridges were recovered from the possession of the petitioner. There is no compliance of Section 100 Cr.P.C.

Patna High Court Cr.Misc. No.37065 of 2016 (3) dt.26-10-2016 2/2 On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- VII, Nalanda at Biharsharif in connection with Manpur P.S.Case No. 36/2016.
