The petitioner seeks bail in Fatuha P.S. case No. 540 of 2015 under Section 366, 366A, 372, 373 of the Indian Penal Code. Later on Sections 3,4,5 of Immoral Traffic Act were added. The mother of the victim alleged that her daughter was married but she was not having good relation with her husband. She was missing from her house but later on the informant got information on her mobile that her daughter was kept in a house situated near Shitla Mandir, Munger. On such, a raid was conducted and daughter of the informant was recovered from the house of petitioner. The victim alleged that one Pappu brought her and kept her in the house of petitioner. The learned counsel for the petitioner submits that on
Patna High Court Cr.Misc. No.37498 of 2016 (3) dt.18-11-2016 2/2 raid three girls were recovered from the house of petitioner for which Munger Kotwali P.S. case No. 275 of 2015 was registered. The petitioner has already been granted bail in the aforesaid case. The victim is a major lady. The petitioner is in jail since 07.01.2016 in the present case.
Considering the fact that victim was recovered for which Munger Kotwali P.S. case No. 275 of 2015 was registered and in that the petitioner has already been granted bail and the petitioner is in jail for more than ten months, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Patna City, Patna in Fatuha P.S.
