====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 08-09-2025 Heard learned counsel for the petitioner as well as the learned APP for the State.

2. The petitioner apprehends his arrest in connection with Samastipur Town P.S. Case No. 231 of 2024, registered for the offences punishable under Sections 406, 409, 420, 34 of the Indian Penal Code.

3. According to allegation, the petitioner was assigned the work of testing the gold ornaments placed by the customers in the Bank for loan purposes. The ornaments were found to be fake.

4. The learned counsel for the petitioner has submitted that the loanees have been granted anticipatory bail as they deposited the entire amount with interest and on that basis co-accused Manoj Kumar Sah, who was also assigned the work of testing the gold

Patna High Court CR. MISC. No.29794 of 2025(2) dt.08-09-2025 2/3 ornaments, has been granted anticipatory bail by a co-ordinate Bench of this Court in Cr. Misc. No. 19073 of 2025.

5. On the other hand, Mr. Vivek Prasad, learned counsel for the Bank has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Samastipur in connection with Samastipur Town P.S. Case No. 231 of 2024, subject to the conditions as laid down under Section 438(2) of the CrPC/482(2) of the BNSS, with other following conditions:- (i) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the court and on his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the Court below.

(ii) If the petitioner tampers with the evidence or the witness, in that case, the persecution will be at liberty to move for cancellation of bail.

(iii) And further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the

Patna High Court CR. MISC. No.29794 of 2025(2) dt.08-09-2025 3/3 court below shall take steps for cancellation of bail bond of the petitioner. However, the acceptance of bail bond in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.

(iv) The learned court below shall verify whether the person to whom the loan was granted on the basis of the test done by the petitioner has deposited the entire amount with interest or not. If it is found that he has not deposited the amount with interest to the Bank, the learned court below shall be at liberty to pass appropriate orders, including cancellation of the bail bond of the petitioner.
