This application has been filed for quashing of order dated 10.06.2015 passed by learned Addl. District and Sessions Judge-I, Vaishali at Hajipur in S.Tr. No. 73 of 2012 arising out of Hajipur Town P.S. Case No. 82 of 2010 for the offences under Sections 324, 307, 427, 379 of the Indian Penal Code by which learned Magistrate dismissed this application. It has been alleged that the informant found that the boundary wall situated in front of his house was demolished and when he asked about the same, petitioner's husband, namely, Dhurandhar Pd. Gupta, assaulted the informant. It has been further alleged that petitioner handed over a bottle of acid to her husband who threw it upon informant which caused injury. Patna High Court CR. MISC. No.43577 of 2015(2) dt.17-05-2023 2/2 facie a strong case is made out against the petitioner. In view of the law laid down by the Hon'ble Supreme Court in the case of State of Bihar Vs. Ramesh Singh reported in 1977 SCC 4 39, this application is dismissed.
The Trial Court is directed to expedite the trial in connection with in S.Tr. No. 73 of 2012 arising out of Hajipur Town P.S. Case No. 82 of 2010 for the offences under Sections 324, 307, 427, 379 of the Indian Penal Code.
