The petitioner seeks bail in Dighwara P.S. Case No. 154 of 2014, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code.

The prayer for bail of the petitioner was earlier rejected vide order dated 07.05.2015 and 02.12.2015 passed in Cr. Misc. No.6899 of 2015 and Cr. Misc. No.45244 of 2015 respectively. The trial court was directed to conclude the trial but even after lapse of more than one year the trial has not yet been concluded. The petitioner is in jail since 29.06.2014.

The petitioner has already remained in jail for 21⁄2 years and the Additional Sessions Judge X, Saran at Chapra could not be able to conclude the trial on one pretext or the other although in

Patna High Court Cr.Misc. No.40431 of 2016 (3) dt.21-12-2016 2/2 his earlier report he had undertaken to conclude the trial very soon.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge X, Saran at Chapra in Dighwara P.S.
