JUSTICE BIRENDRA KUMAR ORAL ORDER 30-01-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offence punishable under Section 409/34 of the Indian Penal Code.

Allegation is of defalcation of public money which was meant for construction of the school building. Submission is that the Headmaster is also coaccused. He has deposited 50% of the amount. The petitioner was Secretary of the School and she was a co-signatory of the cheque, as such, co-accused with the Headmaster. Petitioner is also ready to deposit 50% of the amount, however, in four equal monthly installments.

No.51825 of 2016 (6) dt.30-01-2017 2/2 Considering the undertaking of the petitioner, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad/Successor Court, in connection with Parasbigha P.S. Case No.101 of 2016. Receipt of deposit of first installment would be deposited at the time of filing of bail bonds and the receipt of remaining installments shall also be deposited regularly before the Court-below.
