The petitioner apprehends his arrest in Mahila (Patna) P.S. Case No. 18 of 2016 instituted for the offence under Sections 354, 504 and 506 of the Indian Penal Code and Section 66D of Information Technology Act.
It is alleged that informant was preparing for competitive examination and lived in Chawla Girls Hostel, Patna. The petitioner was also taking coaching. He used to tease her when she went for coaching and always tried to talk with her on mobile phone. It is alleged that he sent vulgar messages and photo of the informant on her facebook after preparing fake I.D. and also
Patna High Court Cr.Misc. No.7449 of 2017 (2) dt.23-02-2017 2 / 2 threat her from various telephone numbers, as mentioned in the written report and also used to send vulgar messages on her mobile phone. It is alleged that petitioner is continuously torturing her since July, 2013 till date.
In such circumstances, since there is serious allegation against this petitioner of torturing the informant this court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this anticipatory bail petition is hereby rejected. The petitioner is directed to surrender before the court below within four weeks from today and seek regular bail which shall be disposed of in accordance with law preferably on the same day without being prejudiced by this order.
