JUSTICE ARVIND SRIVASTAVA ORAL ORDER 02-02-2017 Heard learned counsel for the petitioners and learned counsel for the State.

Petitioners are accused in connection with Sonepur P.S. Case No. 102 of 2016 registered under Sections 396/397 of the I.P.C. and late on, section 412 of the I.P.C. was added. The accusation is that 5-6 persons entered in the house of the informant in the night of 8/9.03.2016 and committed dacoity. While committing dacoity, they killed two persons. Submission is that there is no cogent material against the petitioners, except the confessional statement of coaccused. Petitioners are in custody since 15.03.2016 and charge has already been submitted in this case. Further submission is that similarly situated co-accused persons namely, Vijay Nut and others, Kishore Nut and Laljhari Devi have already been allowed

Patna High Court Cr.Misc. No.48221 of 2016 (3) dt.02-02-2017 2/2 bail by different Benches of this Court vide Cr. Misc. Nos. 29367 of 2016, 32350 of 2016 and 23414 of 2016 respectively. Having considered the facts and circumstances of the case, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of A.C.J.M.-I, Saran at Chapra in connection with Sonepur P.S. Case No. 102 of 2016.
