The petitioners seek pre-arrest bail in connection with Kadwa P. S. Case No. 21 of 2015 registered under Sections 366 A and 120 B of the Indian Penal Code.

Regard being had to the statement of the victim recorded under Section 164 of the Code of Criminal Procedure as contained in Annexure-2 to the present application, in the event of arrest or surrender before the court below within six weeks from today, Md. Aslim (petitioner no. 2) is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with

Patna High Court Cr.Misc. No.42389 of 2015 (2) dt.12-10-2015 2/2 two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in Kadwa P. S. Case No. 21 of 2015 , subject to the conditions as laid down under Section 438

(2) of the Code of Criminal Procedure.

So far Saheb Alam (petitioner no. 1) is concerned, his application for pre-arrest bail is rejected.
