The application is for grant of bail in connection with Sono PS case no. 36 of 2016 for the offence under Sections 304B, 201, 120B/34 of the Indian Penal Code.
It is submitted on behalf of petitioner that petitioner is the husband of the deceased but from materials collected during course of investigation, it appears that as a matter of fact, petitioner has no role in the occurrence rather the deceased herself committed suicide by burning herself and the witnesses have also supported the aforesaid fact. It is further submitted that petitioner has also received burn injuries while saving the deceased and lastly, it has been submitted that charge sheet has already been submitted under Section 306 of Indian Penal Code
Patna High Court Cr.Misc. No.47416 of 2016 (3) dt.18-01-2017 2/2 and not under Section 304B of Indian Penal Code and petitioner is in custody for about seven months.
Heard learned A.P.P. also. Learned A.P.P. has also supported the fact that witnesses have supported the version that the deceased herself has committed suicide. Having heard both sides. In view of the facts stated above, materials available in case diary and that petitioner is in custody for about seven months, the bail application of petitioner is allowed and he is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jamui in connection with Sono P.S. case no. 36 of 2016.
