The petitioner apprehends his arrest in connection with Mohiuddin Nagar P.S. Case No. 231 of 2016 registered under Sections 30 and 38 of the Bihar Excise Act. Learned counsel appearing on behalf of the petitioner submits that neither the petitioner is owner nor the driver of the vehicle. Further submission is that petitioner is named in the F.I.R., but nothing has been recovered from the conscious possession of the petitioner, which is evident from the seizure list. Petitioner has no criminal antecedent. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within
