JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-10-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,,148,149,323,307,379,427,506 and 504 of the Indian Penal Code.

The prosecution case is that the petitioners along with co accused Nandji Manjhi dismantled the hutment of the informant and on protest being made, the informant's family members were assaulted and valuable articles were taken away. It is also alleged that the petitioners and others gave life threatening to the informant.

No.39982 of 2015 (2) dt.06-10-2015 2/2 It is submitted by the learned counsel for the petitioners that the accusation is omnibus and general and the injury has been found to be simple. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. It is further submitted that for the occurrence of 28.5.2015 at 8 A.M. the FIR was registered on the same day at 6.10 P.M. Considering the delayed lodging of the FIR, the petitioners having no criminal antecedent and the accusation being general and omnibus, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Gopalganj in connection with Uchkagaon P.S. Case No. 81 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
