JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 23-02-2024 Re :- Interlocutory Application No.17 of 2023 This Interlocutory Application has been filed on behalf of the parties stating therein that they have compromised the case on the basis of compromise entered between the parties and make the said compromise to be part of the decree and, therefore, prayed to disposed off this appeal. The term of compromise has been stated in paragraph no.3 of the interlocutory application.
2. The application is supported with the affidavits of the respective parties.
3. The office has reported that appellant as well as

4. Learned counsels for both the parties submit that in view of the compromise taken between the parties which are incorporated in paragraph no.3 of the interlocutory application, this case may be disposed off.
5. Having heard learned counsel for the parties and in view of the office notes, the I.A. No.17 of 2023 is allowed. Re :- Second Appeal No.177 of 1999
6. Second Appeal No.177 of 1999 is disposed off in terms of the compromise stated in paragraph no.3 of the Interlocutory Application and the same be part of the decree.
7. LCR of the case be sent to the court concerned.
