The petitioner seeks bail in connection with Kishanpur P.S.Case No. 145 of 2016 registered under Sections 379 and 411 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that the petitioner is a truck driver of the truck which was seized carrying incriminating aluminium coil. He had loaded the aluminium coil in Purnea and was going to Delhi for which the consigner had provided him valid VAT challan, Tax invoice and other receipts, which would clearly show the name of the consigner and the consignee. It is also contended that the petitioner has got no criminal antecedent and has got roots in the

Patna High Court Cr.Misc. No.39731 of 2016 (2) dt.19-09-2016 2/2 society.

Regard being had to the nature of offence and the submissions made at the Bar, the petitioner Anil Kumar, who is in custody since 9th July, 2016, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul in connection with Kishanpur P.S.Case No. 145 of 2016.
