Choubey, learned Standing Counsel8, appearing on behalf of the State. Learned counsel for the petitioner seeks permission to withdraw this application with liberty to apply for prohibitory injunction against respondent No.1, Krishna Paswan, in Title Appeal No.19 of 1991 as also Mutation Appeal No.4/2011-12, who has allegedly trying to forcibly took possession of the suit property, pending in the Court of Additional District Judge-I, Patna and A.D.M., Patna respectively.
No objection has been raised to the prayer for withdrawal made by the petitioner.
Patna High Court Cr. WJC No.41 of 2016 (2) dt.30-01-2016 2/2 In view of the above and in the interest of justice, the application is hereby disposed of as withdrawn with liberty granted to the petitioner to apply for prohibitory injunction against respondent No.1, Krishna Paswan, in Title Appeal No.19 of 1991 as also Mutation Appeal No.4/2011-12, who has allegedly trying to forcibly took possession of the suit property, pending in the Court of Additional District Judge-I, Patna and A.D.M., Patna respectively, and/or to take recourse to such provisions of law as may be permissible.
