Learned counsel for the State accepts notice for the respondents.
Learned counsel for the petitioner is hereby directed to serve copy of the petition to learned counsel for the State.
In the instant petition, petitioner has prayed for the following relief/reliefs:
"I. For issuance of writ in the
Patna High Court CWJC No.9676 of 2021 dt.18-02-2022 2/3 nature of mandamus directing the respondents to forthwith give time bound promotion to the petitioner which is due to him since 1995 and all other benefits in consequence thereof be also directed to be given to the petitioner.
II. For issuance of any other appropriate writ(s), order(s) or direction/s for which the petitioner is found entitled to in the facts of the case."
Learned counsel for the petitioner is relying on Annexure-1-Representation stated to have been submitted to respondent no.2, District Magistrate, Munger. Perusal of Annexure-1, it is not a detailed representation like furnishing service particulars of the petitioner and relevant material to establish that he is entitled for time bound promotion. Therefore, he is hereby directed to submit detailed representation to respondent no.2, District Magistrate, Munger, within a period of four weeks from the date of receipt of this order. On receipt of the petitioner's representation, the District Magistrate, Munger,
Patna High Court CWJC No.9676 of 2021 dt.18-02-2022 3/3 is hereby directed to examine the petitioner's service particulars read with relevant scheme/rules governing the time bound promotion. If the petitioner is eligible, in that event, order of time bound promotion be issued alongwith the monetary benefits like difference of pay. If he is not entitled, in that event, a detailed speaking order shall be passed as to why the petitioner is not entitled to time bound promotion. The above exercise shall be completed within a period of three months from the date of receipt of the petitioner's representation to be submitted.
With the above observation, writ petition stands disposed of.
