The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 307, 435, 427 of the Indian Penal Code and 27 of the Arms Act.
It is alleged that the accused persons including the petitioners came variously armed and assaulted the
Patna High Court Cr.Misc. No.36090 of 2015 (2) dt.21-08-2015 2/3 informant and others when Shyam Sundar Thakur, Ram Chandra Thakur and Shila Devi received injuries. Accused persons resorted to firing causing injury to the informant, Shila Devi and Janki Devi and thereafter the accused persons set the hutment on fire.
It is submitted by learned counsel for the petitioners that none of the injured from the informant side has received firearm injury and the injury has been found superficial, marginal size when there is a counter version of the occurrence also and in the background of land dispute the accusation has been levelled. The petitioners' side have also received injury and co-accused Ramrati Devi has lodged Phulpras P.S. Case No. 135 of 2014.
A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Mgistrate, Jhanjharpur, Madhubani in connection
