JUSTICE SANDEEP KUMAR ORAL ORDER 07-03-2022 At the very outset, learned counsel for the petitioners submits that the present application has become infructuous as the petitioner No. 3 (Anirudh Rai) has been arrested and seeks permission to withdraw the same.

It is, thus, dismissed as withdrawn as having become infructuous.

Learned counsel for the petitioners is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

Patna High Court CR. MISC. No.32876 of 2021(2) dt.07-03-2022 2/3 The petitioners apprehend their arrest in connection with Riga P.S. Case No. 399 of 2020 registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code. Learned counsel for the petitioners submits that petitioner No. 2 (Meera Devi) is the Nand aged about 26 years, but it has been wrongly mentioned in the petition that she is aged about 60 years.

Learned counsel for the petitioners is permitted to make necessary correction in the name and age of the petitioner No. 2.

Considered the submissions of the parties.

The petitioners No. 1 and 2 are the Bhaisur and Nand of the deceased and there is general and omnibus allegation against them.

Considering the facts and circumstances, the prayer for anticipatory bail of the petitioners No. 1 and 2 is allowed. Accordingly, let the petitioners No. 1 and 2 (Ranjan Rai and Meera Devi) be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate

So far as petitioner No. 4 (Fool Devi) is concerned, she is the mother-in-law of the deceased and there are specific allegations of torturing and demand of dowry, her prayer for grant of anticipatory bail is rejected.
