====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 26-07-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with G.R.P. Bakhtiyarpur P.S. Case No. 54 of 2021 lodged under Section 414 of the Indian Penal Code.
Learned counsel for the petitioner submits that present petitioner has named in the F.I.R. but nothing incriminating has been recovered from his possession. One Redmi screen touch mobile has been alleged to be recovered from his possession. He submits that no T.I.P. has been conducted either of the article or of the person in this case. He further submits that petitioner is in custody since 21.10.2021. On the point of two criminal antecedents of petitioner he submits that petitioner is on bail in
Patna High Court CR. MISC. No.22350 of 2022(2) dt.26-07-2022 2/3 both the cases and shall not involve in any criminal case of this type in future and ready to fulfill all the conditions, whatever it may shall be imposed upon the petitioner.
Learned counsel for the State submits that condition may be imposed upon the petitioner in such a manner so that his trial may be concluded.
In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.50,000/- (Rupees Fifty thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate Rail, Patna in connection with G.R.P. Bakhtiyarpur P.S. Case No. 54 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C. One of the bailor shall be the close relative of the petitioner and in this regard the said bailor shall file an affidavit describing his relation with the petitioner.
The petitioner is directed to file and affidavit before the lower court that he shall not involve in any criminal case during the continuance of the trial, in case it has been found that he has involved any such type of cases, the prosecution shall be at liberty to move for cancellation of his bail bond. The petitioner is also directed to appear on each and
Patna High Court CR. MISC. No.22350 of 2022(2) dt.26-07-2022 3/3 every date before the Trial Court, in case of non-appearance for two consecutive dates, shall resulted into cancellation of his bail bond.
With this observation, the bail application stands allowed.
