The application is for grant of bail for the offence under Sections 420, 401, 402, 467, 468, 414, 216A of the Indian Penal Code.
It has been submitted that nothing has been recovered from the possession of the petitioner and he has been falsely implicated in the present case only on the basis of suspicion. Learned counsel for the petitioner further submitted that petitioner is a man of clean antecedent and has been languishing in judicial custody since 17.08.2016.
Heard learned A.P.P. also.
Having heard both sides, in view of the fact that
Patna High Court Cr.Misc. No.54961 of 2016 (2) dt.22-12-2016 2/2 there is recovery of one stolen motorcycle along with a mobile containing the sim of Nepal, from the possession of the petitioner and he is in custody for more than four months, learned court below is directed to expedite the matter and frame the charge in this case and after framing of charge the learned court below shall release the petitioner on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount to his satisfaction.
