After the Court took a grim view of the conduct of these petitioners and the Court not really being satisfied as to the reasons for not carrying out the direction of the university to not occupy the allotted official quarters, the petitioners have finally seen sense and have shifted to the allotted quarters. This position is certified even by the counsel for the university. The Court comes to a considered opinion that there could have been reasons for the misgivings and assertion of the right before this Court for hanging on to the accommodation they were already in by virtue of the fact that their father as guardians were occupants of such accommodation.
The issue should now be set to rest. The ViceChancellor is directed to take a magnanimous view of the matter and will consider waiving the penal rent imposed upon the petitioners.
However, these petitioners will be cautioned not to take decisions,
Patna High Court CWJC No.857 of 2014 dt.17-04-2015 3/3 contrary to the directives of the authorities, because the Court cannot be as indulgent and magnanimous in the next occasion.
Writ application stands disposed off with the observation / direction as above.
