This is an application seeking some modification/extension of time to avail the privilege granted to the petitioner (original petitioner no. 1) vide order dated 23.06.2014 passed in Cr. Misc. No. 15433 of 2014, in connection with Complaint Case No. 769C of 2012 (Khagria), pending before Judicial Magistrate, Ist Class, Khagaria. The period to avail the privilege of bail was earlier extended vide order dated 03.09.2014 passed in Cr. Misc. No. 35460 of 2014, but though the subsequent order was received in time, but the earlier order could be there with the court below only on the fag end of the stipulated period. Hence, the petitioner failed to avail the privilege.

In view of the above, on the terms and conditions as imposed upon the petitioner vide order dated 03.09.2014 passed in Cr. Misc. No. 35460 of 2014, the period to avail the privilege granted to the petitioner vide order dated 23.06.2014

Patna High Court Cr.Misc. No.49898 of 2014 (2) dt.09-01-2015 2/2 passed in Cr. Misc. No. 15433 of 2014 is extended till 23rd January, 2015.
