JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 23-11-2016 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner wants to renew his prayer of bail, which was earlier rejected vide order dated 18.04.2016 passed in Cr. Misc. No. 55442 of 2015, on the ground that the petitioner is suffering in custody since 18.09.2015 after his surrender and other co-accused have been allowed bail by different Benches of this Court to which the learned APP opposes by submitting that this case is of the year 2002 and the petitioner remained absconding for 13 years and the petitioner has also got criminal antecedent and further there is allegation that the petitioner opened fire with AK 47 and four empty cartridges of AK 47 were recovered from the place of occurrence also.

In the facts and circumstances stated above, finding no good ground for reconsideration of prayer for bail of the

Patna High Court Cr.Misc. No.49850 of 2016 (2) dt.23-11-2016 petitioner, again his prayer for bail stands rejected in connection with Nawanagar P.S. Case No. 111 of 2002 pending in the court of learned Chief Judicial Magistrate, Buxar.

However, considering the period of detention of the petitioner, let the trial be expedited and concluded as early as possible, preferably within six months from the date of receipt/production of a copy of this order.
