JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-12-2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 147, 148, 149, 341, 323, 385, 387, 504, 506 of the IPC. Allegedly, petitioner and three others demanded Rs. 50,000/- as extortion money from the informant but submission on behalf of petitioner is that the wife of the informant is member of District Board and as a matter of fact, the petitioner and others did some work under Manrega Scheme and when they demanded their dues, the informant, at the instance of his wife lodged this false case.
He further submitted that the co-accused Md. Rabbani, has lodged Bahawanipur P.S. Case No. 188 of 2017
Patna High Court Cr.Misc. No.67412 of 2018(2) dt.04-12-2018 2/2 against the informant of the present case and others. Para 3 of the petition goes to show that petitioner does not have any criminal antecedent.
Considering the aforesaid facts and circumstances as well as submission of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of his arrest/surrender within four weeks from the date of receipt of this order to the concerned court shall be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in Bhawanipur P.S. Case No. 187/2017 subject to the condition as laid down under Section 438(2) of the Cr.P.C.
