JUSTICE BIRENDRA KUMAR ORAL ORDER 17-12-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341,323,307,504,506/34 of the Indian Penal Code and Section 27 of Arms Act.

The petitioner is alleged to have caused firearm injury at the leg of the informant.

Submission is that there is case and counter case. The injury has not been caused on any vital part of the body. There is no allegation of repetition of firing. The petitioner has got no criminal antecedent.

Considering the nature of allegation

Patna High Court Cr.Misc. No.68666 of 2018(2) dt.17-12-2018 2/2 aforesaid against the petitioner, I am not inclined to enlarge him on anticipatory bail in connection with Surajgarh P.S. Case No.107 of 2018 pending in the court of learned C.J.M., Lakhisarai. Hence, prayer is refused.

Petitioner may surrender and pray for regular bail.
