JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-04-2019 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 10.10.2017 passed in Cr.Misc.No.45529 of 2017 and there is allegation against the petitioner and other co-accused persons is of firing. Submission of learned counsel for the petitioner is that there is no specific allegation of firing against the petitioner and he is in custody for about two years and till date only two witnesses have been examined and they have not named this petitioner.

Heard learned APP also.

In the facts and circumstances, I am not inclined to grant bail to the petitioner.

However, learned trial court is directed to expedite the trial so as to conclude it within a period of one year.

Patna High Court CR. MISC. No.24552 of 2019(2) dt.17-04-2019 2/2 If the trial is not concluded within the specified period, the petitioner may move for bail before the trial court itself, who will pass a detailed order mentioning the evidence for and against the petitioner.

With the above observation, this application is dismissed.
