2. The petitioner seeks regular bail in connection with Saur Bazar P.S. Case No. 447 of 2023 registered on 03.08.2023 lodged under Sections 25(1-B)(a)26 of the Arms Act.
3. As per the prosecution case, F.I.R. has been lodged against sole petitioner against whom there is recovery of one country made pistols, live cartridges as well as empty cartridges upon which police has apprehended the petitioner.
4. Counsel further submits that petitioner is innocent and has committed no offence. He further submits that his cousins are on enimical terms with the petitioner and on their instance, the present case has been lodged. Counsel further submits that he is in custody since 04.08.2023 having no
Patna High Court CR. MISC. No.23982 of 2024(2) dt.04-04-2024 2/2 criminal case pending against him. Charge-sheet has already been filed in this case. He further submits that from the seizure list, it transpires that the brother to whom he is on enimical terms are witnesses of the seizure list. Counsel has specifically pleaded in paragraph 8 of the petition that land dispute is going on between the petitioner and his cousins.
5. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail after framing of charge if the charge is not framed yet and on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-II, Saharsha in connection with Saur Bazar P.S. Case No. 447 of 2023, subject to the conditions laid down under Section 437 (3) of the Cr.P.C. (Dr. Anshuman, J) Sunnykr/- U
