JUSTICE MUNGESHWAR SAHOO ORAL ORDER 17-09-2016 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner namely Pahwari Lal Chouhan is in custody since 27.06.2016 in Sonepur Rail P.S. Case No.50 of 2016 under Sections 379, 411/34 of the Indian Penal Code. The allegation is that from the possession of this petitioner, Rs.2,000 was recovered and it is alleged that he had committed theft of the Attachy of the informant who was sitting by the side seat of the informant and the informant returned by train from Chapra to Sonepur where the petitioner has been caught.

In view of the nature of allegation and the fact that the informant went upto Chapra and therefrom he returned and from

No.38947 of 2016 (2) dt.17-09-2016 the possession of this petitioner Rs.2,000 only has been recovered, I direct that the petitioner named above be released on bail on furnishing bail bond of Rs.5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the Court of learned Railway Judicial Magistrate, Sonepur in connection with Sonepur Rail P.S.
