JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 21-10-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Kadwa P.S. Case No. 63 of 2016 registered under Sections 341, 323, 504, 326 and 307/34 of the Indian Penal Code and later on, Section 302 of the Indian Penal Code has been added.

The accusation of informant, Saraswati Devi, is that, on 01.04.2016, in the evening, her grand son, namely, Golu Kumar also ate articles (Biscut) from the shop, on which, petitioner, who is the daughter-in-law of informant, came and started to quarrel with her. In that course, her younger son,

Vikash Kumar Sah came and made protest then petitioner assaulted him though stool. Thereafter, husband of the informant asked her why did she assaulted to his younger son then petitioner thrown a metal pot (Lamp) over her husband, due to which, she sustained injury on her nose. In the meantime, husband of the petitioner, who is the elder son of the informant, came at the house and started to abuse her and threatened of dire consequences. Thereafter, husband of the petitioner took bottle with petrol and pored over her body and let on fire by stick of match, due to which, she burnt. Thereafter, informant was rushed to the hospital. Learned counsel for the petitioner submits that, in fact, it would appear from the F.I.R.

that the allegation against the petitioner is only to make quarrel on seeing the grand-son of informant for taking Biskut from the shop and allegation for putting fire on the informant is against her husband, Raju Sah. Considering the aforesaid submissions, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.
