JUSTICE ALOK KUMAR SINHA ORAL ORDER (Per: HONOURABLE THE ACTING CHIEF JUSTICE) 12-09-2025 In the instant petition, petitioners have prayed for the following reliefs:
(i) For issuance of a Writ of Mandamus directing the respondents to select the site of proposed Panchayat Sarkar Bhawan within the habitant area easily assessable to common natives of the
Patna High Court CWJC No.6493 of 2025(2) dt.12-09-2025 2/3 Panchayat concerned and give momentum to the site selection and construction work of the proposed Panchayat Sarkar Bhawan within a fixed time framed period so that the price of construction of the proposed Panchayat Sarkar Bhawan could not escalate further and the benefit of the same could be made available readily to people of concerned Panchayat.
(ii) For issuance of a direction to the respondents to complete the all processes of construction of the Panchayat Sarkar Bhawan in the all Panchayats within the territorial jurisdiction area of the State of Bihar within a fixed time framed period.
(iii) For the direction to respondent no. 03 to 09 for selecting a site for construction Panchayat Sarkar Bhawan within the area of Mohamadpur Pohoyar of Salha Panchayat under the jurisdiction of Block- Sahdei Buzurg, Sub-Division-Mahnar and District of Vaishali at Hajipur till June 2025 as per the scheme and direction of the Panchayat Raj Department, the Government of Bihar.
iv) For any other order or orders, direction or directions for which the common people of the State of Bihar are entitled may be passed by this Hon'ble Court under the facts and circumstances of the case.

2. Perusal of the pleadings read with the documents, the petitioners have not approached the concerned Authority before approaching this Court in seeking writ of mandamus. In the absence of necessary demand before the concerned Authority followed by some vested rights, writ of mandamus cannot be issued for merely asking.
3. Accordingly, the present petition stands disposed of, reserving liberty to the petitioners to approach the concerned Authority.
