The petitioner seeks regular bail in Bithan P.S. Case No. 159/2017, instituted for the offences punishable under Sections 302, 120(B) and 34 of the Indian Penal Code and section 27 of the Arms Act.
Learned counsel for the petitioner has submitted that petitioner is not named in the written report. In the written report, it is alleged that four persons fired at informant's brother. The informant reached near his brother, then accused persons also fired at him. Informant's brother died on the spot. Three persons are named in the F.I.R. Name of this petitioner has come during investigation, in the confessional statement of coaccused Pankaj Kumar. Pankaj Kumar has already been granted
Patna High Court Cr.Misc. No.68124 of 2018(2) dt.27-11-2018 2/2 bail vide order dated 28.08.2018 passed in Cr. Misc. No. 37143/2018. Petitioner is in custody since 25.07.2018. Considering the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above-named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge, Rosera, Samastipur in connection with Bithan P.S.
