JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-302/201/120B/34 of the Indian Penal Code. Petitioner is not named in the first information report but from perusal of paragraph-32 of the case diary, it would appear that the name of petitioner and two others came in this case on the basis of information, furnished by spy of the police. Subsequently, the co-accused Guddu Singh was arrested and made his confessional statement disclosing the involvement of the petitioner in the present crime.

No doubt, the petitioner does have criminal antecedent of some cases but except the confessional statement of

Patna High Court Cr.Misc. No.46061 of 2016 (3) dt.06-12-2016 2/2 co-accused as well as suspicion, there appears to be nothing against him in the present case. The petitioner is in judicial custody since 29-02-2016 and the investigation against him has already been completed.

Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Maranchi P.S. Case No. 33 of 2015 to the satisfaction of learned Additional Chief Judicial Magistrate, Barh, Patna.
