The petitioner apprehends his arrest in Forbesganj (Simraha) P.S. Case No. 363 of 2016 instituted for the offence under Section (s) 399, 402 of the Indian Penal Code and Section 25(1-b) a, 26, 35 of the Arms Act.
It has been submitted that nothing has been recovered from the possession of the petitioner. The name of the petitioner has come during investigation. The co-accused Chandra Narayan Yadav @ Bhumi and others with similar allegation have already been granted bail by a coordinate Bench of this Court vide Cr. Misc. No. 45 of 2017 on 11.01.2017.
It has been mentioned in para 3 of the petition
Patna High Court Cr.Misc. No.7427 of 2017 (2) dt.22-02-2017 2/2 that petitioner has no criminal antecedent.
In the facts and circumstances of the case, the prayer of the petitioner for anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, above named, within six weeks from today in connection with Forbesganj (Simraha) P.S. Case No. 363 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
