JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-04-2019 The petitioner seeks bail in anticipation of his arrest in connection with Rajnagar P.S. Case No. 324 of 2018, dated 04.10.2018, instituted for the offences under Sections 272 and 273/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act. It appears that a truck with the registration number of Haryana was found abandoned at a lonely place. From the aforesaid truck, liquor in huge quantity is said to have been recovered. The F.I.R. reveals that the police received secret information that the consignment of liquor has been brought at the instance of the petitioner.

No.19943 of 2019(2) dt.03-04-2019 2/2 The learned counsel for the petitioner submits that but for such information to the police whose source has not been disclosed in the F.I.R., there is no other material to connect the petitioner with the recovery and, therefore, the offence charged.

The petitioner has clean antecedents.

Considering the facts aforestated, the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-II-Cum-Special Judge, Excise Act, Madhubani, in connection with Rajnagar P.S. Case No. 324 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
