The petitioner seeks bail in Bhabua (Sonhan) P.S.Case No.319/18 /G.R. No.1048/18 registered under Sections 302, 201 of the I.P.C.

Allegation as per the F.I.R. is that dead bodies of two persons were lying in the river and a case had been lodged against unknown. Later on name of the petitioner transpired on the basis of confessional statement of co-accused Dharmendra Yadav.

Submission of the learned counsel for the petitioner is that except confessional statement of co-accuse Dharmendra Yadav there is nothing against the petitioner. He is aged about 70 years as he has stated on oath in para13 of the case diary and he is in custody since17.07.2018.

No.67739 of 2018(2) dt.29-11-2018 2/2 Heard the learned A.P.P. and the informant also who opposed the prayer for bail of the petitioner stating that it is a case of unnatural death which has been done due to property dispute. Except C.D.R. location there is no incriminating article against him.

Having heard both sides and in view of the fact that the petitioner is aged about 70 years, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Kaimur at Bhabua, in Bhabua (Sonhan) P.S.Case No.319/18, G.R. No.1048/18 subject to the condition that bailors of the petitioner shall be of local having sufficient immovable properties.
