JUSTICE SUDHIR SINGH ORAL ORDER 03-10-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 47A of the Bihar Excise Act.
Allegation against petitioner is that from his possession 3.960 litres of wine was recovered.
It has been submitted on behalf of petitioner that he is in custody since 27.7.2016. Petitioner has got no criminal antecedent. The alleged recovery of wine is denied by petitioner. There is no compliance of Section 100 of the Code of Criminal Procedure. On behalf of the State, it is submitted that petitioner is named in the prosecution report.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like
Patna High Court Cr.Misc. No.42288 of 2016 (2) dt.03-10-2016 2/2 amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Excise Case no. 220 of 2016.
