The present petition has been filed with a prayer to restore Miscellaneous Appeal No.365 of 2012, which stood dismissed due to non- compliance of peremptory order dated 29.11.2012. By the said order six weeks time was granted for removing all the defects. This order was peremptory. Among the defects, one of the defect was non- deposit of statutory amount Besides hearing the parties, I have also perused the grounds set forth in the petition. The grounds set forth in the petition are not sufficient to persuade the court to allow this petition.
