JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-07-2015 Heard learned counsel for petitioner and learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Govindganj P.S. Case No. 105 of 2014 registered under Sections-406, 420, 120B, 392 and 411/34 of the Indian Penal Code.
One Balmiki Prasad lodged a case in respect of theft of his motorcycle. The investigating officer of the aforesaid case started investigation and in that course, he got information regarding recovery of motorcycle. It was also detected that Rs. 2,50,000/- (two lacs and fifty thousand) in cash was found in the dicky of aforesaid motorcycle. Subsequently, one Santosh Kumar and Rajeev Kumar were
Patna High Court Cr.Misc. No.47592 of 2014 (4) dt.28-07-2015 2/2 arrested and made their confessional statement. The coaccused Santosh Kumar confessed that the case of theft of motorcycle was lodged with intent to digest the seized amount and petitioner was also his associate. Considering the aforesaid facts and circumstances as well as submission of the parties, in the event of his arrest or surrender within four weeks from the date of receipt/production of copy of order in the court below, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Govindganj P.S. Case No. 105 of 2014 to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran subject to conditions as laid down u/S 438(2) of the Cr. P.C. (Hemant Kumar Srivastava, J) A.K.V./- U T
