JUSTICE SUDHIR SINGH ORAL ORDER 15-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 147, 341, 323, 324, 307, 354, 379 of the I.P.C. Later on, Section 302 I.P.C. was added. Accusation is that the accused persons including the petitioner assaulted the husband of the informant by iron rod on his head and during treatment her husband died. It has been submitted on behalf of the petitioner that the petitioner is in custody since 19.09.2016 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. General and omnibus allegation has been made. No specific injury has been attributed
Patna High Court Cr.Misc. No.52663 of 2016 (2) dt.15-12-2016 against the petitioner. Specific allegation has been made against the co-accused Dayanand Paswan. The case was instituted under Section 307 I.P.C. Later on Section 302 I.P.C. has been added. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Madhepura P.S. case No.156 of 2016.
