Petitioner is in custody in connection with Buniyadganj P.S. Case No. 50 of 2018 for the offence under section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner would submit that in the instant case total 25 kg. of Mahua flowers and 10 liters of Mahua liquor was seized.
Learned counsel submits that nothing was recovered from the conscious possession of the petitioner rather recovery was made from the joint house of the petitioner. The petitioner is in custody since 31.01.2019. Considering the fact that Mahua flowers and liquor was seized from the joint possession and not from the exclusive

No.19672 of 2019(2) dt.01-04-2019 2/2 possession, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Judge, Gaya, in connection with Buniyadganj P.S. Case No. 50 of 2018. However, while releasing the petitioner, the court below is directed to see that both the bailors should be elected representative of the local body as the petitioner was made accused in similar such cases in the past also.
