Heard learned counsel for the parties.

Petitioner is in custody since 11.9.2019 in a case registered for the offences punishable under Sections 379/411of the Indian Penal Code on the allegation that he along with other co-accused committed theft of a motorcycle of the informant. Learned counsel appearing for the petitioner submits that the petitioner has falsely been implicated in this case. Petitioner has not been put on test identification parade (TIP) till date. Nothing incriminating has been recovered from the petitioner's possession during investigation to connect him with the alleged offence and he has been roped in this case on the confessional statement of a co-accused Amresh Kumar. Considering the facts of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate III, Khagaria in Khagaria (Mufassil) Police Station
