The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 379, 323 and other allied sections of the Indian Penal Code. As per the prosecution case, this petitioner assaulted the informant with butt of pistol due to which his right hand got fractured.

It is submitted that petitioner has been falsely implicated in this case. All the sections are bailable in nature except section 379 IPC which is super addition. The dispute arose between the parties over the demarcation of land in which both sides sustained injuries. There is case and counter case. Counsel for State opposed and submitted that petitioner is named in the FIR and caused grievous injury to the

Patna High Court CR. MISC. No.22289 of 2023(2) dt.06-07-2023 2/2 informant. Petitioner has got one criminal antecedent of Arms Act.

Considering the facts aforesaid and nature of injury and criminal antecedent of the petitioner, I am not inclined to enlarge the petitioner above-named on anticipatory bail in connection with Mahnar P.S. Case No. 133 of 2022. Accordingly, the same is rejected.
