Petitioner is accused in connection with Surajgarha P.S. Case No. 176 of 2016 registered under Sections 147, 148, 341, 323, 307, 447, 337 and 448 of the I.P.C. The allegation is that petitioner along with other coaccused entered in the house of the informant armed with iron rods and started assaulting him, his mother and father brutally. Learned counsel appearing on behalf of the petitioner submits that the present case is nothing but counter blast lodged against the informant and others vide Surajgarha P.S. Case No. 175 of 2016 for the same offence. It is also submitted that petitioner and informant are Gotiya and the alleged occurrence
Patna High Court Cr.Misc. No.49788 of 2016 (6) dt.10-02-2017 2/2 took place due to land dispute, in which both the parties have injured. Further submission is that both the parties have compromised the case and petitioner is in custody since 18.09.2016.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Lakhisarai in connection with Surajgarha P.S. Case No. 176 of 2016.
