JUSTICE ASHUTOSH KUMAR ORAL ORDER 22-06-2020 Heard Mr. Manoj Kumar, learned counsel for the petitioner and Md. Aslam Ansari, learned APP for the State. The petitioner seeks bail in connection with Bairiya P.S. Case No. 318 of 2019, dated 25.09.2019, instituted for the offences under Sections 25(1-b)a, 26 and 35 of the Arms Act.
The prayer for grant of bail of the petitioner was earlier rejected by a Bench of this Court vide order dated 18.12.2019.
It appears that one country made pistol and cartridges were recovered from the possession of the
Patna High Court CR. MISC. No.19836 of 2020(2) dt.22-06-2020 2/2 petitioner.
The petitioner is now in custody since nine months from 26.09.2019. There is no other case against the petitioner, as it appears from the statement made in paragraph 3 of the bail petition.
Considering the facts afore-stated and the period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Bettiah, West Champaran in connection with Bairiya P.S. Case No. 318 of 2019.
The application stands allowed.
